The Unfair Advantage · TradeSniper S1 Classic
TradeSniper S1 Classic Terms of Sale
Please read this first
All sales are final.
Every TradeSniper S1 Classic purchase is final. Once you pay, there are:
- No refunds
- No returns
- No exchanges
- No credits
No credit of any kind: no store credit, no account credit, no partial refund and no goodwill refund.
This is true for any reason, including when:
- you change your mind;
- the market goes against you, or you lose money trading;
- you do not use your S1, or you stop using it;
- you bought the wrong level, or you want a different one;
- an exchange you want to use is not open to you where you live, or it limits or closes your account;
- your internet, your equipment or your setup does not suit the S1;
- you cancel your monthly plan, or it stops because a payment did not go through.
Returns need our written authorization first.
Nothing may be sent back to us unless we first give you a written return authorization through our support site. A package sent back without one is not a return. We may refuse it. If it reaches us anyway, it is still yours: tell us within 30 days and we ship it back once you pay the shipping. It earns no refund, no credit and no exchange, and receiving or holding it does not mean we accepted a return.
Nobody else can change this. Not a chat moderator, an affiliate, another member or an AI assistant. Only a written return authorization from us, sent through our support site, counts.
What these terms do give you
- a repair or replacement if your box arrives damaged or has a hardware fault when you first set it up, and you tell us within 7 days (section 11);
- a refund only when we cannot ship your order on time and you choose to cancel, or a lost parcel cannot be replaced (section 10), or when we cancel your order (section 13);
- every right the law says no one can take away (section 15).
2Who you are buying from
You are buying from Fibonacci Technologies LLC, a Wyoming limited liability company ("we", "us"). TradeSniper, the TradeSniper S1 Classic and The Unfair Advantage are our products and brands.
These Terms of Sale cover every TradeSniper S1 Classic purchase, and every accessory and Connect device bought on our shop, whether or not an S1 is in the same order: on our shop, on our phone buying page, and through any S1 offer we send you by link or by invitation. GIZMO purchases are covered by the GIZMO Terms of Sale instead. Charts-and-chat memberships bought on their own are covered by our Terms of Service.
Our Terms of Service and Privacy Policy also apply. If they and these Terms of Sale say different things about a purchase these terms cover, these Terms of Sale control. The same is true if any other page, email, message or chat says something different about refunds, returns, shipping or warranty. Accepting our Terms of Service or any terms shown on the box, before or after you buy, does not replace these Terms of Sale.
You must be 18 or older (or the age of adulthood where you live, if that is higher) to buy.
3What the S1 is, and what it is not
- The S1 is a data service through a hardware machine. The machine is a small computer (the "box"), sold with a matching keyboard and mouse. It runs our TradeSniper software and shows market data, charts, signals, alerts and trade tools from our online service.
- It is software and data, not financial advice. It is education and tooling. We are not your broker, adviser or bank.
- We never hold your money or crypto, and we never trade on our own. Your money stays in your own exchange accounts. Every trade comes from your settings and your decisions.
- No promise of profit. Trading can lose money, even all of it. Words on our pages such as "A.I.", "OSIRUS", "signals", "calls", "snipes", "auto-trade" or "The Unfair Advantage" describe what the software is built to do, or name our brands. They are not promises of any result.
- The S1 is an experimental product. We keep updating it. Screens, features, coin lists, signals and calls change over time.
- Photos are examples. The box you get may look different, for example its case, size or color, or the parts inside it. It runs the same TradeSniper software.
- The box needs its monthly plan. TradeSniper's data, signals and trade tools come from our service. Without an active level, your account and your box drop to the free level, and the paid features stop (section 8).
- What you need: a wired internet connection (a network cable from the box to your router), a monitor (the keyboard and mouse come in the box; one of our video switches lets you share the monitor your PC uses), and accounts at the exchanges you want to use.
- Your exchanges are your job. Check before you buy that the exchanges you want are open to people where you live. If an exchange is not available to you, or limits or closes your account, that is not a reason for a refund. Anything we share about VPNs or other networking tools is information only, not a recommendation: following the law and your exchange's rules where you live is your job alone. Section 6 of our Terms of Service (exchange connections) also applies.
4What we sell
- Gold + S1 Classic: the S1 box with its keyboard and mouse (one-time price) plus the Gold level (a monthly plan).
- Platinum + S1 Classic: the S1 box with its keyboard and mouse (one-time price) plus the Platinum level (a monthly plan).
- Platinum Pro + S1 Classic: the S1 box with its keyboard and mouse (one-time price) plus the Platinum Pro level (a monthly plan).
- On our shop, the S1 is sold only this way: the box together with a monthly plan. There is no S1 without a monthly plan, and no yearly or lifetime S1 package.
- Accessories and Connect devices: for example the 4K Video Switch, the 8K Remote Video Switch, the Soundbar and the Connect 12. One-time price. A Connect device works only alongside a TradeSniper unit on your account and an active level; check that before you buy.
- Offers by invitation or private link: an S1 offer we make by invitation or private link may have its own price, term or payment method, set out in writing in that offer. Everything else in these terms applies to it.
What each level includes is shown on the product page, and it can change over time (section 3).
You own the box. The TradeSniper software on it is licensed to you, not sold (section 5 of our Terms of Service).
These terms also cover any other S1 offer we sell, including offers we send by private link.
5How you pay
- You pay the total shown on the pay page when you pay. Prices are in U.S. dollars.
- What you pay today for an S1 package: the box, plus the first month of your level, plus shipping. Your next monthly charge comes one month later, and then every month (section 6).
- Stripe processes card payments, including Apple Pay and Google Pay. We never see or store your full card number.
- Your card or bank statement may show our company name or one of our brand names.
- Prices on our pages can change. A change never alters what you already paid. For monthly plans, see price changes in section 6.
6Monthly plans: they renew until you cancel
Every S1 package includes a monthly plan for its level: Gold, Platinum or Platinum Pro.
- They renew automatically every month, at the monthly price you agreed to, until you cancel. We charge the payment method you used on the same day of the month you first paid for that plan (or on the last day of a shorter month).
- How to cancel: send a cancel request through our support site: https://theunfairadvantage.support. You can also use your account's billing / subscription page where it offers a cancel option. We act on a cancel request promptly, and it stops all future charges for that plan. Your level stays on until the end of the month you already paid for.
- Cancelling the monthly plan does not cancel the box. The box was a one-time purchase. It stays yours, with no refund (section 8).
- No refunds or credits for any month, or part of a month, already charged. That includes when you cancel early, stop using your S1, or forget to cancel.
- Price changes: if we change the monthly price of a plan you have, we will tell you at least 7 days (and no more than 30 days) before the new price applies, with how to cancel. You can cancel before it does.
- A declined payment stops your level at once. Your account and your box drop to the free level. Our payment processor may try your card again for a short time. If a retry goes through, your level comes back by itself. When the retries stop, the plan is cancelled, and we do not promise any way back in on the same terms (section 8).
7Setting up, software updates, and no remote access
- Setting up is a sign-in. Connect your monitor, the keyboard and mouse, and a network cable, and switch the box on. Start TradeSniper, agree to its terms, and sign in with the same username and password you use in our chat. There is nothing to scan and nothing to link. If your level is active, the data starts right away.
- Software updates. We improve TradeSniper by publishing software updates. When one is ready, your box tells you, and you choose when to install it from the box's screen. An update restarts TradeSniper, so the box warns you first if you have open trades. A new box may need an update when you first set it up. Install updates when they come out: a box on old software may not work as described.
- No remote access, ever. Nobody at our company can log in to your box, control it, or reach into it from a distance. There is no remote access of any kind. The updates you install are the only way our changes reach your box. This also means we cannot fix your box from a distance: help comes through our support site, through updates and, for a box that arrives damaged or dead, through section 11.
- What the box sends us. The box connects to our service to confirm your level, get market data and check for updates. It also shares the usage data described in our Privacy Policy.
8If your monthly plan stops
- Why it can stop: a payment is declined (section 6), you cancel, a payment is disputed (section 12), or your account is closed for breaking these terms or our Terms of Service.
- What stops: your account and your box drop to the free level. The paid features stop, including the data, signals and trade tools on the box and the paid chat rooms.
- Your open trades are your responsibility. Positions and orders already at your exchange stay there when your level stops, and the box may stop watching or managing them, including stops it manages. Check and manage them yourself. The same is true while an update restarts TradeSniper.
- The box stays yours. We do not take it back. Its paid features come back when a paid level is active again on your account.
- Coming back later. Once a plan is cancelled, we do not promise any way back in on the same terms. If you come back, you pay the prices in force that day: old prices end with the old plan.
9One level per account, and changing levels
- One S1 level per account at a time: Gold, Platinum or Platinum Pro.
- Your S1 runs at the level of the package you bought.
- An account that holds an S1 cannot also hold a GIZMO. A GIZMO needs its own account, with a different email.
- A charts-and-chat plan is replaced. If your account already has a monthly or yearly charts-and-chat plan, your S1 package's plan replaces it when you buy, whatever its level. We tell you before you pay. The old plan ends at once, with no refund or credit for the rest of its term.
- Moving between levels: moving between Gold, Platinum and Platinum Pro is handled personally through our support site. When a new monthly plan replaces your old one, the old plan ends at once, with no refund or credit for the rest of its month.
- Moving down to a lower level is not offered.
- From GIZMO to S1: moving from a GIZMO to an S1 is handled personally through our support site. Every GIZMO level on that account, including the Coin Expansion Pack, ends and is replaced by the S1 level. Your GIZMO box stays yours, without a GIZMO level. There is no refund or credit for any GIZMO purchase or unused time.
- A second S1: buying a second S1, or buying an S1 for someone else, is handled personally through our support site.
10Shipping and delivery
- Shipping cost. Shipping is shown in the cart and on the pay page. An S1 package ships for $126.88 inside the USA and $296.86 outside the USA, charged once per package with your first payment. Accessories and Connect devices have their own shipping prices.
- When we ship. We ship within 30 days of your order, unless the product page gives a different time. Delivery time after that depends on the carrier and where you live.
- More than one package. Items in one order may ship separately. Each package's tracking counts on its own, and you never pay shipping twice for the same item.
- Your address. Give a full, correct shipping address. We ship only to the address on your order, and we cannot change it after the order ships. We may require a signature on delivery.
- Sent back to us. A package may come back to us because the address was wrong or incomplete, nobody accepted or collected it, or customs charges were not paid. We ship it again once you pay the new shipping cost. That is not a reason for a refund.
- Delivered means delivered. When the carrier's tracking shows your order delivered to the address you gave us, it counts as delivered. From then on the order is yours, including the risk of loss, theft or damage.
- Outside the USA. You pay any import duties, taxes, customs or brokerage fees your country charges. They are not part of our price.
- Lost in transit. If tracking stops moving before delivery, tell us through our support site within 30 days of the ship date. When the carrier confirms the loss, we send a replacement. If we cannot send one within 30 days, you may cancel that item for a refund.
Shipping delays: a rule of U.S. law. If we cannot ship your order within the time we stated (or within 30 days, if we did not state one), we will tell you. You can then choose to wait for a new ship date, or cancel. If you cancel, we refund the order in full (except for anything in it that has already shipped to you), and any monthly plan bought with it ends. This is required by the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule.
11If your box arrives damaged or dead: our 7-day limited warranty
- Does an S1 box, its keyboard or mouse, an accessory or a Connect device arrive damaged, or have a hardware fault when you first set it up (for example, it will not power on or start up)? Tell us through our support site within 7 days after it is delivered. Include your order email and a photo or video that shows the problem.
- If we confirm the problem, we will repair or replace it, at our choice. That is the only remedy: no refund and no credit.
- If we need the item back, we send you a written return authorization and a prepaid shipping label. We pay to ship the repaired or replacement item to you.
- This warranty is for the original buyer only. It does not cover problems caused after delivery, for example drops, spills, power surges, opening the box or changing its software.
- After the 7 days, the box is yours as it is (section 14).
Your warranty rights. Any implied warranty, such as merchantability or fitness for a particular purpose, is limited to the same 7 days, to the extent the law allows. We are not responsible for incidental or consequential damages, such as trading losses, caused by a damaged or dead box. Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from State to State. The warrantor is Fibonacci Technologies LLC, 75 E 3rd St, Sheridan, WY 82801; warranty claims are made through our support site.
12Chargebacks and payment disputes
- You agree that you saw these Terms of Sale, and accepted them, before you paid.
- Contact us first. If something is wrong with an order, tell us through our support site before you go to your bank. It is the fastest way to fix it.
- Your right to dispute stays yours. Nothing here stops you from disputing a charge with your bank or your card issuer. But a purchase you made or authorized, that was delivered or provided as described, is not a billing error just because these terms do not allow a refund.
- We answer every dispute. We send your bank these terms, the record that you accepted them, your order details, proof of shipping and delivery, and records of your account and box activity (such as sign-ins and check-ins).
- While a dispute is open, your S1 level stops, the same as a declined payment. If the dispute ends in our favor, it comes back.
- Money taken back is still owed. If a bank reverses a payment for a purchase you made or authorized and received, the level or package it paid for ends, and you still owe us that amount. We may collect it in other ways (never by charging your card again), including in small-claims court.
13Orders we may refuse or cancel
We may refuse or cancel an order before it ships, for example if we think the payment is fraud, the order breaks the one-level-per-account rule, or we cannot confirm the buyer. If we cancel an order, we promptly refund in full what you paid for it. Cancelling is our decision: asking us to cancel does not give you a right to a refund.
14"As is", and limits on our responsibility
The TradeSniper software and data service are provided "as is" and "as available", to the fullest extent the law allows. The box itself is covered only by the 7-day limited warranty in section 11. We do not promise that the service will be error-free or always online, or that any data, signal, alert, call or order will be right, on time, or carried out.
We are not responsible for trading losses, lost profits, or indirect, incidental, special or consequential damages, to the fullest extent the law allows. Our total responsibility is limited as set out in section 16 of our Terms of Service: the amount you paid us in the 12 months before the event that led to the claim.
Some places do not allow some of these limits. There, they apply as far as the law allows.
15Rights the law does not let us take away
Nothing in these terms takes away a right that the law says cannot be given up. For example:
- the U.S. shipping-delay refund in section 10;
- your right to dispute any charge with your card issuer (section 12);
- implied warranty rights that some U.S. states do not let a seller limit;
- if you live in the EU, the UK or another place whose law gives you a right to cancel an online purchase (in the EU and the UK, 14 days from delivery), you keep it. To use it, tell us through our support site within that time. You then send the item back at your own cost, unless that law says otherwise, and we refund as that law requires. For a monthly service the 14 days run from your order; if you asked us to start it at once and then cancel, you pay for the days used. Consumer guarantees that your local law always gives you also still apply.
If a part of these terms is not allowed where you live, only that part drops away. The rest still applies.
16Disagreements, and the law that applies
Section 18 of our Terms of Service applies to any disagreement about a purchase these terms cover. In short:
- Wyoming law applies.
- First, contact us through our support site with a written description. We both try in good faith, for 60 days, to fix it.
- If that fails: binding individual arbitration with the American Arbitration Association under its Consumer Arbitration Rules, or small-claims court, which either of us may use instead.
- No class actions and no jury trials.
- You may opt out of arbitration within 30 days of first accepting our Terms of Service, through our support site.
17Changes, and how you accept these terms
- Each version of these Terms of Sale has its own number and date. The version shown when you pay applies to that purchase.
- Changes to these terms for future monthly charges follow section 19 of our Terms of Service; price changes follow section 6.
- Ticking or clicking "I agree", or paying, is your electronic signature and your acceptance of these terms, with the same force as a handwritten signature.
- We keep a record of your order and of your acceptance.
